Can the Masjid do the Nikah without a Wali?
The Masjid requires a Wali for Nikah. There are however some exceptions to allow the woman to marry without a Wali. The Masjid evaluates this situation on a case-by-case basis.
If the Wali is not physically attending the Nikah proceedings, can the Nikah Officiant get his consent using a virtual meeting method prior to, or in real time during, the ceremony?
Yes, that can be arranged.
I am a Muslim man, and my fiancé is a Christian. Can I marry her without a Wali?
Generally, no. There are however some exceptions to allow the woman to marry without a Wali. The Masjid evaluates this situation on a case-by-case basis.
I am a Muslim man, and my fiancé is a Christian. Who can serve as her Wali if her Christian father is not in the picture?
She can assign her uncle, grandfather, or one of her relatives to serve as her Wali. This relative must be known of good standing, honest, respected in his community, and he has HER best interest in his heart. He does not have to be a Muslim. If this is not an option, then she can delegate the Imam or another Masjid Official to be her Wali or ask him to assign a Wali for her from the community. Same assumptions on character of Wali shall apply.
I am a Muslim man, and my fiancé is a Christian. Since she is not Muslim, can we do the Nikah without a Wali?
The Masjid is on the opinion that if a Muslim man marrying a woman from People of the Book, she is required to have a Wali. The guardian of a Christian or Jewish woman is a male relative who is a follower of the same religion: her father, grandfather or brother… If there is no such relative or he refuses, then her marriage contract is to be done by the Muslim judge if there is one; if not, her marriage should be done by the director of the Islamic Centre in her locality, because the basic principle with regard to guardianship in the case of marriage is that it belongs to the father, then to male relatives, the closest then the next closest. If there are no male relatives or they are not qualified to be guardians for any reason, or if they refuse for no good reason, then guardianship passes to the ruler or one who takes his place. Fataawa al-Lajnah ad-Daa’imah, 18/162 (Please see this link) As such, we strongly recommend a Wali even if your fiancé’ is not a Muslim. She can assign her father, brother, uncle, or any male family member to be her Wali. If none is available, the Majid will help with that matter.

I am a Muslim man, and my fiancé is a Christian. Who can serve as her Wali if her Christian father is not in the picture?
She can assign her uncle, grandfather, or one of her relatives to serve as her Wali. This relative must be known of good standing, honest, respected in his community, and he has HER best interest in his heart. He does not have to be a Muslim. If this is not an option, then she can delegate the Imam or another Masjid Official to be her Wali or ask him to assign a Wali for her from the community. Same assumptions on character of Wali shall apply.

The Masjid is on the opinion that if a Muslim man marrying a woman from People of the Book, she is required to have a Wali. The guardian of a Christian or Jewish woman is a male relative who is a follower of the same religion: her father, grandfather or brother… If there is no such relative or he refuses, then her marriage contract is to be done by the Muslim judge if there is one; if not, her marriage should be done by the director of the Islamic Centre in her locality, because the basic principle with regard to guardianship in the case of marriage is that it belongs to the father, then to male relatives, the closest then the next closest. If there are no male relatives or they are not qualified to be guardians for any reason, or if they refuse for no good reason, then guardianship passes to the ruler or one who takes his place. Fataawa al-Lajnah ad-Daa’imah, 18/162 (Please see this link) As such, we strongly recommend a Wali even if your fiancé’ is not a Muslim. She can assign her father, brother, uncle, or any male family member to be her Wali. If none is available, the Majid will help with that matter.
